Terms of Service

1. Acceptance of Terms

By accessing or using ManaSift (“the Service”), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

2. Description of Service

ManaSift is an AI-powered resume screening platform that helps hiring teams evaluate candidates using multi-dimensional skill scoring. The Service includes resume parsing, AI-based scoring, candidate management, team collaboration, and related features.

3. Accounts and Access

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must notify us immediately of any unauthorized access to your account.
• One person or organization may not maintain more than one free trial account.

4. Subscriptions and Billing

• ManaSift offers paid subscription plans billed monthly or annually.
• Free trials last 14 days. You will not be charged until the trial ends and you select a paid plan.
• Subscription fees are non-refundable except where required by law.
• We reserve the right to change pricing with 30 days’ notice to existing subscribers.
• Usage beyond your plan limits may incur overage charges at the published rate.
• If payment fails, we may suspend access to your account after a grace period.

5. Your Data

• You retain ownership of all data you upload to ManaSift, including resumes and candidate information.
• You grant us a limited license to process your data solely for the purpose of providing the Service.
• You are responsible for ensuring you have the right to upload and process any data, including candidate resumes.
• You are responsible for complying with applicable data protection laws (including GDPR and state privacy laws) regarding candidate data you process through ManaSift.

6. AI Scoring Disclaimer

ManaSift’s AI scoring is a tool to assist hiring decisions, not a replacement for human judgment. Scores are generated by AI models and may not be perfect.

• AI scores should be used as one factor among many in hiring decisions.
• You are solely responsible for all hiring decisions made using the Service.
• ManaSift does not guarantee the accuracy of AI-generated scores or parsed resume data.
• We recommend reviewing scores and evidence trails before making candidate decisions.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or to discriminate against protected classes
• Upload malicious files, malware, or content that violates third-party rights
• Attempt to reverse-engineer, scrape, or extract our AI models or scoring methodology
• Exceed your plan limits through automated means to avoid paying for usage
• Share account credentials or allow unauthorized access
• Interfere with or disrupt the Service or its infrastructure

8. Intellectual Property

The ManaSift platform, including its design, code, AI models, scoring methodology, and documentation, is owned by ManaSift and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service.

9. Limitation of Liability

To the maximum extent permitted by law, ManaSift shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

• You may cancel your subscription at any time through your account settings.
• We may suspend or terminate your access for violation of these terms.
• Upon termination, your data will be retained for 30 days, after which it will be permanently deleted.
• You may request an export of your data before termination.

11. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the new terms.

12. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Texas.
